Learn about your consumer return rights, cooling-off periods, refund eligibility and protections under UK consumer law when purchasing through Emerebid Auctions.
Sales by public auction are generally exempt from the standard 14-day cooling-off right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Consumer Contracts Regulations”).
You have no general right to cancel an Auction Contract or return a Lot simply because you changed your mind.
However, as a Consumer you retain rights under the Consumer Rights Act 2015 in respect of the Main Characteristics of the Lot. If the Lot does not match its description in the Important Notes or Catalogue, you may have remedies for breach of contract.
These are distance contracts. As a Consumer you benefit from both:
Emerebid Auctions voluntarily offers a 30-day return window for eligible Shop purchases, which exceeds the statutory minimum of 14 days.
You may cancel an Order and return the Goods for any reason within 30 days from the day after you (or someone you nominate) receive the Goods, provided:
The 30-day cancellation right does not apply to:
You are responsible for the reasonable cost of returning the Goods unless the Goods are faulty, damaged, or not as described. In those circumstances we will arrange collection or reimburse reasonable return costs.
We will refund the Purchase Price (including standard delivery charges paid) within 14 days of receiving the returned Goods or proof that they have been sent back.
Refunds are made to the original payment method. We may deduct a reasonable amount for any diminished value caused by handling beyond what is necessary to inspect the Goods.
These rights apply to both Auction Lots and Shop Goods purchased by Consumers.
You must notify us of the issue within a reasonable time (ideally within 30 days of delivery for obvious faults).
Your statutory rights are not affected by the 30-day voluntary return policy.
If you are not a Consumer, the 30-day cooling-off right and short-term right to reject do not apply.
Returns are accepted only for faulty or damaged Goods in accordance with the main General Terms & Conditions.
Return rights are subject to the Delivery and Collection Policies.
Failed or refused deliveries may affect your ability to exercise cancellation rights.
Storage or redelivery charges may apply in cases of default.
Nothing in this Schedule, the General Terms & Conditions, or the eCommerce Shop Terms affects your statutory rights as a Consumer under:
