• Bid – Offer to purchase a lot.
• Bidder – Person placing a bid.
• Buyer – Successful bidder or purchaser.
• Buyer Premium – Additional percentage fee applied to purchases.
• Contract – Binding sale agreement.
• Seller – Owner of the item being sold.

2. Role of Emerebid Auctions

Emerebid Auctions primarily acts as an agent for sellers. Therefore, buyers and sellers usually form the contract of sale directly with each other unless we clearly state otherwise.

3. Registration & Auction Conduct

• Users must register with accurate information.
• Photo identification may be required.
• We may restrict participation at our discretion.
• We may withdraw or amend lots before a sale begins.
• The Three Minute Rule applies to eligible auctions.

4. Contract Formation

Auction contracts form when we accept the highest qualifying bid at the close of an auction. Similarly, shop purchases create a contract once we successfully confirm payment.

5. Warranties & Item Condition

Unless we clearly state otherwise, we sell items “as seen”. Therefore, buyers must inspect items carefully and understand their condition before they bid or make a purchase.

6. Risk, Title & Delivery

• Ownership transfers after full cleared payment.
• Risk transfers according to applicable consumer status.
• Collection and delivery conditions apply.
• Buyers should arrange insurance once risk transfers.

7. Price, Payment & Fees

• Hammer Price or Purchase Price.
• Buyer Premium.
• VAT where applicable.
• Delivery and handling fees.
• Late payment charges may apply.

8. Default & Resale

If a buyer fails to pay, collect or accept delivery, we may apply storage fees. In addition, we may terminate the contract, resell the item and recover any related costs.

9. Liability & Indemnity

We limit liability to the maximum extent permitted by law. However, consumers always retain rights that the law does not allow us to exclude.

10. Data Protection

We process personal information according to our Privacy Policy and applicable data protection laws. Furthermore, we take reasonable steps to protect customer data.

11. Consumer Rights

Consumer protections apply whenever the law requires them. In addition, buyers may receive additional rights when purchasing fixed-price products through our online shop.

• However, any invalid provision will not affect the remaining clauses.
