Auction Terms & Conditions

1. Eligibility

To participate in auctions on EMERE Marketplace, users must be at least 18 years of age and legally capable of entering into binding agreements.

EMERE reserves the right to approve, suspend, reject, or terminate any user account at its sole discretion.

2. Account Registration

Users must provide accurate and complete information during registration.

• Valid name and contact details
• Accurate billing information
• Current email address
• Compliance with marketplace policies

Providing false or misleading information may result in suspension or permanent removal.

3. Bidding Rules

• All bids are legally binding.
• Bids cannot be withdrawn once submitted.
• The highest valid bid at auction closing wins the lot.
• Reserve prices may apply.
• Bid extensions may occur near auction closing.

4. Winning Bids

Winning bidders are required to complete payment within the timeframe stated on the auction listing or invoice.

Failure to complete payment may result in account restrictions, suspension, cancellation of the transaction, or additional administrative fees.

5. Payment Terms

• Payment instructions will be provided after auction completion.
• Applicable taxes and fees may apply.
• Late payment charges may be imposed.
• Ownership transfers only after full payment has been received.

6. Collection & Delivery

Buyers are responsible for reviewing collection and delivery requirements before placing bids.

• Collection deadlines must be respected.
• Storage charges may apply to uncollected items.
• Delivery costs are the responsibility of the buyer unless otherwise stated.

7. Condition of Goods

Unless otherwise specified, all lots are sold on an "As Is, Where Is" basis.

• No guarantee of condition.
• No guarantee of functionality.
• No guarantee of fitness for purpose.

Buyers should carefully review all photographs, descriptions, and supporting documentation before bidding.

8. Prohibited Activities

• Fraudulent bidding.
• Shill bidding.
• Identity misrepresentation.
• Marketplace abuse.
• Attempting to bypass platform fees.

9. Suspension & Termination

EMERE reserves the right to suspend or terminate accounts that violate marketplace policies, fail to complete transactions, or engage in prohibited activities.

10. Limitation of Liability

EMERE acts solely as a marketplace platform connecting buyers and sellers.

To the fullest extent permitted by law, EMERE shall not be liable for indirect, incidental, or consequential losses arising from the use of the platform.

11. Changes to Terms

EMERE may modify these Terms & Conditions at any time. Updated versions will be published on this page.
